If you are experiencing domestic violence, you can apply to the Court for a domestic violence order imposing certain conditions on the person who has committed the violence. Temporary protection orders are available for urgent matters. These orders often state that the person must be of good behaviour towards you and not commit domestic violence as well as conditions surrounding going within a certain distance of your home or workplace. In considering applications for domestic violence orders, the Court must be satisfied that domestic violence has occurred and that an order is necessary and desirable for your protection.
If the police or another person apply for a domestic violence order naming you as the respondent, you can either object to the making of that order, however, a temporary order will likely be made in the interim until the matter can proceed to trial on a later date, or, you can consent to the order being made (generally without admitting to the domestic violence that the application alleges).
